Because of default in the payment of the indebtedness secured by a Security Deed executed by DENISE C. GRAHAM and NINA ELAINE JACKSON to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. dated June 26, 2007, in the amount of $108,497.00, and recorded in Deed Book 308, Page 125, Banks County, Georgia Records, as last transferred to Mortgage Electronic Registration Systems, Inc. by assignment, the undersigned, Mortgage Electronic Registration Systems, Inc. pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in May, 2009, during the legal hours of sale, at the Courthouse door in Banks County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit:
All that tract or parcel of land, together with improvements thereon, lying and being in GMD 912 in Banks County, Georgia, and being lot 1 (containing 2.00 acres) on Moccasin Gap Road as shown on that subdivision plat recorded in Plat Book 31, Page 31 of the Banks County, Georgia Plat Records, and which plat is hereby incorporated by reference for a more complete description of said property. ALSO CONVEYED is a 1998 Fleetwood 58X48 Spring Hill manufactured home with serial number GAFLW34ABCD27737SH12 which is permanently affixed to the above realty and considered a part thereof.
Said property is conveyed together with and subject to all easements, covenants, and restrictions of record, if any.
which has the property address of 325 Moccasin Gap Road, Lula, Georgia, together with all fixtures and other personal property conveyed by said deed.
The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorneys’ fees in accordance with the terms of the note secured by said deed.
Said property will be sold as the property of Denise C. Graham and Nina Elaine Jackson and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.

By Order for Service by Publication dated the 9 day of March, 2009, you are hereby notified that on February 6, 2009, the Banks County Department of Family and Children Services, Georgia Department of Human Resources, filed a Petition for Temporary Custody against you as to the above-named child alleging the child is deprived. You are required to file with the Clerk of Juvenile Court, and to serve upon Special Assistant Attorney General Jeffrey K. Williams, an answer in writing within sixty (60) days of the date of the Order for Service by Publication.
