By virtue of a Power of Sale contained in that certain Deed to Secure Debt from HARRY FARRELL to GREEN TREE FINANCIAL SERVICING CORPORATION nka GREEN TREE SERVICING, LLC, dated November 3, 1998, and recorded in Deed Book 136, Page 350, in the Office of the Clerk of Superior Court of Banks County, Georgia, said Deed to Secure Debt having been given to secure a Note, dated November 3, 1998, in the original principal amount of ONE HUNDRED EIGHTEEN THOUSAND SEVEN HUNDRED TWENTY TWO AND 67/100 DOLLARS ($118,722.67) with interest thereon as provided therein, will be sold at public outcry to the highest bidder for cash before the Courthouse door of Banks County, Georgia, within the legal hours of sale on the first Tuesday of March 2009 regarding the following described property:
All that tract or parcel of land lying and being in the 284th GMD, Banks County, Georgia, containing 10.00 acres, as shown on a Plat of Survey for Harry Farrell, recorded in Plat Book 23, Page 119, Banks County Records, said plat being incorporated herein by reference.
This is a portion of the property conveyed to Richard T. Wolf and Pun Song Wolf by deed, dated March 28, 1987, and recorded in Deed Book 115, Page 267, Banks County Records.
Said property is commonly known as 448 Daily Rd., Alto, GA 30510.
The indebtedness secured by said Deed to Secure Debt has been and is hereby declared due because of default under the terms of said Deed to Secure Debt and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorney’s fees and all other payments provided for under the terms of the Deed to Secure Debt and Note.
